Tech Law and Cyberlaw

Technology law and Cyberlaw (or Internet Law) are arguably the most fluid areas of law today. The laws regulating technology are changing almost as quickly as the technology they are attempting to regulate.

Courts

A few local courts have their own web sites. In Santa Clara, see the Superior Court at http://claraweb.co.santa-clara.ca.us/sct.

You can check the status of any case in any Appellate or Supreme Court proceeding in California through this site http://www.courtinfo.ca.gov/opinions. By navigating through the site, you can even register to be notified of specific opinions, or check the record of a particular case (for example see: http://appellatecases.courtinfo.ca.gov/search/dockets.cfm?dist=6&doc_id=22136&div=&case=H021961)

You can also find information on cases in Federal Court by visiting the Supreme Court's site http://www.supremecourtus.gov/opinions/opinions.html or any of the Federal Appellate sites. California is in the 9th Circuit their site is at http://www.ca9.uscourts.gov.


Personal and Civil Rights & Criminal Law

The American Civil Liberties Union provides information on civil rights on their site at www.aclu.org. They publish a downloadable document on individual's rights when contacted by police - http://www.aclu.org/library/bustcard.html, or you can view the guidelines in your browser by clicking here.

The U.S. Government is required to make much of its internal information available to the public through the Freedom of Information Act. For information on obtaining data under FOIA, you can visit the Justice Department's FOIA information page at http://www.usdoj.gov/04foia/index.html.


Organizations

The TBD has worked with the Electronic Frontier Foundation www.EFF.org, the Institute of Electrical and Electronics Engineers (IEEE) www.IEEE.org the Computer Communications Industry Association http://www.ccia.org and The First Amendment Project www.thefirstamendment.org. Each of these groups provides information on technology and the law.

Our attorneys donate time to community projects, including the Community Technology Alliance www.ctagroup.org. CTA is dedicated to using technology to help homeless and at risk adults and children. Many of our attorneys also donate time and resources to a number of different projects at our local university http://www.scu.edu, including their award-winning legal newspaper The Santa Clara Advocate www.scuadvocate.org.
